A 19-year-old was charged with the death penalty by a Special Court in Rajasthan after he was caught raping a 7-month-old infant in May. This is the first such sentence in the state after the implementation of criminal law ordinance on April 21st, which introduced IPC Section 376 AB under which a death penalty is provisioned to those who are convicted of raping a child below 12 years of age.
The death penalty was awarded to Pintu by Special Court hearing of SC/ST Act and Pocso Act in Alwar after he was found guilty of raping a 7-month-old infant in Laxmangarh, Alwar district on May 9th. Special public prosecutor Kuldeep Jain stated that the Special Judge Jagendra Agrawal, who conducted daily hearings in the case for 30 days had held Pintu guilty for the crime on July 18th.
Alleged Pintu was convicted under IPC sections 363, 366A for the abduction of minor and 376AB for rape on a woman under 12 years of age and 5(M)/6 of POCSO Act. The given death penalty was under the IPC Section 376AB as stated by SHO Prahlad Sahay, Laxmangarh Police Station.
On May 9th Pintu abducted the infant from her house when she was alone with her half-blind grandmother and took her to a nearby school building and raped her. The locals there caught him during the act and handed him over to the police. Suman Sharma, Rajasthan State Women’s Commission Chairperson said, “the decision will set a precedent and will bring relief to mothers who worry about the safety of their daughters”.
