The Supreme Court has not found any new grounds for a rethink on its May 2017 decision to award death penalty in the Nirbhaya gangrape-murder case. One accused, Ram Singh, committed suicide during the trial of this case. A juvenile has already served three years in a reform home. Other three; Mukesh, Pawan, Vinay and Akshay was given death penalty by Delhi High Court and then the same decision was secured the Supreme Court.
Yesterday, a bench of Chief Justice Dipak Misra and Justices R Banumathi and Ashok Bhushan had heard appeals filed by the accused.
Justice Bhushan, who authored the judgment on behalf of the bench has mentioned in his remark that no new ground has been made out which may furnish any ground to review the judgment. Thus, these review petitions are dismissed. Referring to the convicts’ questioning over the scientific investigation by Delhi police, Justice Bhushan mentioned that oral and scientific evidence has been elaborately considered by this court and the petitioner/accused cannot re-agitate the same point again.
However, the convicts have the option of seeking presidential commutation of their death sentences.
